Learned counsel for the petitioners submits that petitioner no.1 is the owner of the land in question and altercation took place for possession of the land. He next submits that the petitioners’ side have lodged first case and thereafter the present case has been lodged and the petitioners have been falsely implicated in the instant case.

Learned State counsel opposes prayer and submits that allegation of assault is there.

Considering that there are case and counter case between the parties and from the FIR, it transpires that altercation took place due to possession of the land in question and it has been further stated that the petitioner no.1 is the owner of the land in question and the first case has been lodged by the petitioners’ side and thereafter the instant case has been lodged, and in that view of the matter, the petitioners, above named, are directed to surrender before learned court within two weeks from today and learned court shall release petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
