1. Heard learned counsel for the applicant and learned counsel for the State. 2. The applicant who is in custody since 28.07.2025 has renewed his prayer for grant of regular bail in connection with Pratappur P.S. Case No.137 of 2024 (S.T. Case No.326 of 2025), registered for the offence under Sections 103(1) & 3(5) of the Bharatiya Nyaya Sanhita, pending in the court of learned Additional District Judge-III, Chatra.

3. Earlier the prayer for grant of regular bail was twice dismissed by this Court vide orders dated 16.02.2026 and 08.04.2026 passed in B.A. Nos. 10250 of 2025 and 2797 of 2026 respectively.

4. It has been submitted by the learned counsel for the applicant(s) that complete set of FIR along with its enclosure have been annexed with this bail application and there is no suppression on his/her part.

5. Learned counsel for the applicant has claimed innocence and has undertaken that the applicant shall cooperate and participate in the trial. It has been submitted that the victim was found in an injured condition in front of a petrol pump and later succumbed to her injuries. The applicant has come under suspicion merely on the ground that he was allegedly in a relationship with the deceased. It has further been submitted that the material witnesses, including the family members of the deceased, have been declared hostile and there is no other cogent material connecting the applicant with the alleged offence. On these grounds, prayer for grant of bail has been made.

6. Learned counsel for the State has opposed the prayer for bail.

2026:JHHC:21228 7. Considering the above facts, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-III, Chatra in connection with Pratappur P.S. Case No.137 of 2024 (S.T. Case No.326 of 2025), subject to condition that the applicant(s) will submit self-attested photocopy/photocopies of his/her/their Aadhaar Card(s) and also submit his/her/their mobile number(s) before the trial court which he/she/they will always keep active and will not change it during pendency of this case without prior permission of the court.
