1. Heard learned counsel for the applicant, learned counsel for the State and learned counsel for the informant.

2. The applicant who is in custody since 23.10.2025 has renewed his prayer for grant of regular bail in connection with Kunda P.S. Case No.102 of 2025 corresponding to S.T. Case No.249 of 2025, registered for the offence under Sections 103(2) & 61(2)(a) of the B.N.S., 2023, pending in the court of learned Additional Sessions Judge-II, Deoghar.

3. Earlier the prayer for bail of the applicant was dismissed as withdrawn vide order dated 10.03.2026 passed in B.A. No.1377 of 2026.

4. It has been submitted by the learned counsel for the applicant(s) that complete set of FIR along with its enclosure have been annexed with this bail application and there is no suppression on his/her part.

5. Innocence has been claimed by the learned counsel for the applicant and undertaking has been given for participation in the trial. It has been submitted that one of the co-accused namely Manoj Kumar Raut @ Mannu Raut has already been granted bail by the co-ordinate Bench vide order dated 08.12.2025 passed in B.A. No.9285 of 2025. The relevant paragraphs of the said order read as under:-

3. On 13.05.2025, petitioner alongwith co-accused persons are alleged to have assaulted the husband of the informant, due to which he succumbed to his injuries.

4. It was submitted that there is general and omnibus allegation against all the accused persons. It was further submitted that deceased was unauthorizedly fishing in the pond of accused persons, due to which this occurrence has taken place.

On the above basis, prayer for bail has been made.

¶22

6. Learned counsel for the State and the informant have opposed the prayer for bail and it has been submitted that not only the deceased had been brutally assaulted but also, urination had been done upon him. There is also eye witness to the incident.

7. Considering the nature of crime and the material available on record, I am not inclined to enlarge the applicant on bail. Accordingly, the bail application stands rejected once again.
