The petitioners is apprehending their arrest in connection with Peterwar PS Case No.115 of 2025, for offence registered under section 126(2), 115(2), 118(1), 324(4), 74, 109(1), 303(2), 351(2), 352, 3(5) of BNS, 2023, pending in court of learned S.D.J.M, Bermo at Tenughat.

Learned counsel for petitioners submits that false case has been lodged against the petitioners. He next submits that the informant party has tried to damage the boundary wall of the petitioners and that was sought to be stopped by the petitioners and thereafter the altercation took place. He also submits that there are case and counter case between the parties and for the same incident, both the sides have lodged the case. He next submits that injury is found on the hand of the husband of the informant.

Learned State counsel opposes prayer and submits that allegations are there of altercation due to land dispute and in view of that anticipatory bail may kindly be rejected.

Considering that after perusal of the case diary, the learned Sessions Judge has been pleased to found that the informant side has reached to the spot to demolish the boundary wall of the petitioners and for that altercation took place and there are case and counter case between the parties, and in the attending facts and circumstances of the present case, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned S.D.J.M, Bermo at Tenughat, in connection with Peterwar PS Case No.115 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
