02 /07.07.2026 Heard learned senior counsel appearing for the petitioner as well as learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Chandil P.S. Case No.134 of 2025, for the alleged offences registered under Sections 126(2), 115(2), 118(1), 117(2), 118(2), 109, 61(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Sub-Divisional Judicial Magistrate, Chandil.

3. Learned senior counsel appearing for the petitioner submits that so far this petitioner is concerned the allegation of assault are not there. He further submits that the allegation of assault and caught hold the son of the informant are there against Raja Chapad @ Sahil and Faiz. He then submits that only on bottom of the FIR the name of the petitioner has been taken on suspicion with regard to one earlier case between the informant and this petitioner which has been compromised. He next submits that so far Raja Chapad @ Sahil is concerned he has been apprehended and in the confessional statement he has also not taken the

name of this petitioner. On these grounds, he submits that anticipatory bail may kindly be granted.

4. Learned counsel appearing for the State opposed the prayer and submits that the petitioner is named in the FIR.

5. In the FIR the allegations are there upon Raja Chapad @ Sahil and Faiz of assault and caught hold the son of the informant. In the last part of the FIR the only allegation is made against the petitioner that there was a dispute between the petitioner and the informant which was compromised and it is suspected that the petitioner was also involved in the said assault and apart from there is no allegation against the petitioner. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Chandil in connection with Chandil P.S. Case No.134 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
