03/06.07.2026 Heard learned senior counsel appearing for the petitioner, learned counsel appearing for the State and learned counsel appearing for opposite party no.2-informant.

The petitioner is apprehending his arrest in connection with Chutia P.S. Case No.130 of 2022 dated 07.06.2022, registered for the offence under Sections 406, 420, 408, 467 and 120B of the Indian Penal Code, 1860, pending in the Court of the learned Judicial Magistrate, Ranchi.

Learned senior counsel appearing for the petitioner submits that the petitioner happened to be Chartered Accountant and he used to do audit of accounts of Vivekanand Vidya Mandir school. He then submits that the allegations are made that one vehicle of the school has been purchased in the name of one Abhay Kumar Mishra and further allegations are made that certain bank accounts have been opened against the rules and advance payment to the contractor for constructing new building has not been reflected. He also submits that the petitioner is cooperating in the

investigation. He next submits that so far as the said Abhay Kumar Mishra is concerned, he has been granted anticipatory bail by a Coordinate Bench of this Court in A.B.A. No.1629 of 2025. On these grounds, he submits that the privilege of anticipatory bail may kindly be granted to the petitioner.

Learned counsel appearing for the State and opposite party no.2informant jointly opposed the prayer and submit that there is serious allegation against the petitioner of misappropriating the funds as well as not keeping the accounts properly. 5. Learned counsel appearing for the opposite party no.2-informant further adds that due to the act of the petitioner, the said school has been fined sum of Rs.5 Crores and 75 Lakhs by the Income Tax Department and two of the bank accounts of the school have been seized by the Income Tax authority and in view of that act, the school is compelled to take fee in cash to run the school. On these grounds, he submits that the prayer for anticipatory bail of the petitioner may kindly be rejected.

Considering that the petitioner is a Chartered Accountant and it has been pointed out that the petitioner is cooperating in the investigation and the allegations are there that one of the car was purchased in the name of one Abhay Kumar Mishra and the said Abhay Kumar Mishra has been granted anticipatory bail by a Coordinate Bench of this Court in A.B.A. No.1629 of 2025 and in the case of the said Abhay Kumar Mishra, it has been considered by the Coordinate Bench of this Court that subsequently the said vehicle has been transferred in the name of the school and further the allegations are made that without any tender the contract was given to the contractor, who has constructed the new building and this aspect of the matter has also been

considered in the said A.B.A., filed by Abhay Kumar Mishra and it has also been pointed out that the building has already been constructed and further, it has also been pointed out that a retired Judge of this Court is looking after the administration of the said school pursuant to the order of this Court and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ranchi in connection with Chutia P.S. Case No.130 of 2022, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

If the chargesheet is not yet submitted, the petitioner will cooperate in the investigation.
