02 /07.07.2026 Heard learned counsel appearing for the petitioner as well as learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Dhanbad P.S. Case No.176 of 2026, for the alleged offences registered under Sections 126(2), 115(2), 117(2), 303(2), 352, 351(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Chief Judicial Magistrate, Dhanbad.

Learned counsel appearing for the petitioner submits that there are case and counter case between the parties and in the FIR itself there are references of other cases lodged by the informant against this petitioner. He further submits that the petitioner has received the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and pursuant to that by way of Annexure-2/1 the petitioner has complied in which he has stated that the petitioner was not present on the spot and at that time where the places moved by him have been disclosed and that are the subject matter of investigation. He then submits that the

petitioner is ready to cooperate in the investigation. On these grounds, he submits that anticipatory bail may kindly be granted.

4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of assault and in view of that anticipatory bail may kindly be rejected.

Annexure-2/1 is a document which is addressed to the Officer In-charge of concerned police station of Dhanbad wherein the petitioner has stated that the petitioner at relevant time has moved at different places and has requested to check the CCTV footage to find out his innocence, however, that is the subject matter of investigation and the petitioner is ready to cooperate in the investigation. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Dhanbad in connection with Dhanbad P.S. Case No.176 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
