The petitioner is apprehending his arrest in connection with Giridih Cyber PS Case No.35 of 2025, for offence registered under section 111(2)(ii), 111(3), 111(4), 317(5), 319(2), 318(4), 338, 336(3), 340(2), 3(5) of the BNS, 2023 and Section 66(B), 66(C) and 66(D) of the Information Technology Act, pending in court of learned Additional Sessions Judge-II-Cum-Spl.Judge, Cyber Crime, Giridih.

Learned counsel for petitioner submits that there is nothing against the petitioner of doing any cyber crime and even no money has been transferred in the account of the petitioner. He next submits that only on the basis of talking with one Md. Kalim Ansari the evidence regarding commission of cyber fraud was found. disclosed in paragraph no.10 of the petition.

Learned State counsel opposes prayer and submits that the petitioner was found talking on several times with co-accused namely, Md. Kaleem Ansari.

Considering that only allegation is there that the petitioner has talked with one Md. Kaleem Ansari for certain times and the petitioner is having no criminal antecedent as aforesaid and apart from that, there is no allegation against the petitioner of taking money or introducing anybody to do cyber-crime, and in the attending facts and circumstances of the instant case, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Additional Sessions Judge-II-Cum-Spl.Judge, Cyber Crime, Giridih, in connection with Giridih Cyber PS Case No.35 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
