The petitioner is apprehending his arrest in connection with Hussainabad P.S. Case No. 285 of 2025, registered for the offence under Sections 12692), 115(2), 117(2), 109, 351(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sub Divisional Judicial Magistrate, Palamau.

Learned counsel appearing for the petitioner submits that only allegation made against the petitioner is that he was present on the spot and allegations of assault are there against Niraj Kumar Paswan, who has been granted regular bail considering that on repeated call by the learned court, the injury report was not produced. He further submits that the petitioner is having no criminal antecedent as disclosed in para 14 of the petition.

Learned counsel appearing for the State opposes the prayer and submits that allegation is there of presence of this petitioner on the spot.

Considering that the allegation is there against Niraj Kumar Paswan of assault and he has been granted regular bail by the learned Sessions considering that on repeated call by the court, the injury report has not been produced and only allegation made against the petitioner is that the petitioner was present on the spot and further the petitioner is having no criminal antecedent as disclosed in para 14 of the petition, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within two weeks from today and in the event of

his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Palamau, in connection with Hussainabad P.S.
