The petitioner is apprehending his arrest in connection with Charhi PS Case No.71 of 2023, for offence registered under section 385, 386, 387, 414/34 of Indian Penal Code and Section 25(1-B)a, 26, 35 of the Arms Act, pending in court of learned Judicial Magistrate, First Class, at Hazaribagh.

Learned counsel for petitioner submits that even the crime has not been done and the allegations are there that the petitioner was planning to extort money from the businessmen. He next submits that from the possession of one Sudama Rajak two live cartridges have been recovered and that person was granted regular bail by the Coordinate Bench of this Court in B.A. No.7075 of 2024.

Learned State counsel opposes prayer and submits that 1

Considering that only allegation is made of planning to

extort money by the petitioner, however, the crime was not done as yet and the main accused from whose possession the live cartridges have been recovered has been granted anticipatory bail by the Coordinate Bench of this Court, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, at Hazaribagh, in connection with Charhi PS Case No.71 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
