counsel for the State.

The petitioner is apprehending his arrest in connection with Koderma P.S. Case No. 228 of 2021, registered under sections 406, and 420 of I.P.C and under section 66(D) of the I.T. Act, 2002, pending in the Court of learned Chief Judicial Magistrate, Koderma.

Learned counsel for the petitioner submits that mobile of the petitioner was stolen and subsequently somebody was utilizing the said mobile and created Paytm account and has fraudulently taken certain amount from the victim. He next submits that petitioner has got no role in the said crime and main accused has compromised the matter with the informant. He next submits that F.I.R is of the year, 2021 and after receiving notice petitioner came to know about the present F.I.R. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that mobile of the petitioner was utilized for creating Paytm account and thereafter fraudulently certain amount was taken from the victim.

Considering that mobile of the petitioner was stolen and

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/(twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Koderma, in connection with Koderma P.S. Case No. 228 of 2021, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
