The petitioner is apprehending his arrest in connection with Kenduadih P.S. Case No. 30/2026, registered under sections 191(2)/191(3)/190/126(2)/127(2)/115(2)/109(1)/132/352/351(2)/61(2)/329 (3) of BNS, pending in the Court of learned Judicial Magistrate, Dhanbad.

Learned counsel for the petitioner submits that there are case and counter case between the parties. He next submits that allegations are made that petitioner was doing private mining work and assault was made by him but fact remains that for the job agitation was going on. He next submits that petitioner has got no criminal antecedent which is disclosed in para 8 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations of assault are there.

Looking into contents of F.I.R, it transpires that mob of about 50-60 persons were there on the spot. It is not clear that from whose blow injury has been received by one Bablu Patra. There are case and counter case between the parties and petitioner has got no criminal antecedent which is disclosed in para 8 of the petition.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/(twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Dhanbad, in connection with Kenduadih P.S. Case No. 30/2026, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
