The petitioner is apprehending his arrest in connection with Jorapokhar P.S. Case No.23 of 2026 dated 08.02.2026, registered for the offence under Sections 319(2), 318(4), 336(3), 340(2), 61(2)(a) of the BNS and Section 10(1) of the Public Examinations (Prevention of Unfair Means) Act, 2024, pending in the Court of the learned Judicial Magistrate, 1^st Class, Dhanbad.

Learned senior counsel appearing for the petitioner submits that the petitioner is a student and he is aspiring for job and he has applied for CTET examination, however, he has not been able to appear in the examination due to stomach pain and it has been alleged that another person sat in the examination in place of the petitioner disclosing that the said person is Gautam Kumar (petitioner). He next submits that somebody has produced photocopy of the original document of this petitioner and on the basis of that, the petitioner has been implicated in the case. He also submits that the petitioner has no concern with the said person, who appeared in the examination in place of the petitioner. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there that in place of the petitioner, another person has appeared in the examination.

Considering that the petitioner is a student and on the date of examination, he has not appeared in the said examination due to stomach pain and photocopy of the original document of the petitioner was produced by some person and on that basis, the petitioner has been implicated in the case and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Dhanbad in connection with Jorapokhar P.S. Case No.23 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
