Heard learned counsel for the petitioner and learned APP for the State.

This bail application has been filed on behalf of the petitioner, namely, Vinod Pandit with a prayer to release on bail in connection with Koderma P.S. Case No. 66 of 2024, registered under sections 307, 120-B of the Indian Penal Code and 25(1-B)(a) and 27(2) of Arms Act, pending before the Court of learned Chief Judicial Magistrate, Koderma.

In the FIR, which was lodged by the injured himself on 02.04.2024 had given his written statement with these allegations that Prabhu Pandit is his Gotiya Pattidar and there was land dispute between them. On 01.04.2024 in the evening, he along with his friend Ajay Prasad had gone to respond the call of nature towards the Bhagat Ahra Pond. At 7.00 P.M. when both were coming back to their house, a motorcycle bearing no. JH12E3521 came from behind and by that motorcycle Vinod Pandit and Santosh Pandit both came and they controlled the speed of their motorcycle and Vinod Pandit who was armed with the pistol opened fire upon him which hit to his waist and the blood began to ooz. Again the fire was also opened and both the accused persons fled away. Santosh Pandit was also assisting Vinod Pandit. On raising alarm by his friend Ajay Prasad, the persons of the locality took him to Sadar Hospital, Koderma. From there he was referred for higher treatment and at that time his treatment was going on in Aarogyam Hospital, Hazaribag.

As per allegations made in the FIR, the informant-victim and his friend Ajay Prasad are the eye witness of the occurrence.

Informant injured in his restatement reiterated the averments made in the FIR itself and also stated that while they were coming back from the pond having responded the call of nature, the two persons who came by the motorcycle it was Vinod Pandit, who had opened fire from the pistol which hit to his waist and thereafter, the fire was also opened by the son-in-law of Vinod Pandit, namely, Praveen Pandit who had also came by the another motorcycle. He could not see that by whom that motorcycle was being driven.

The statement of eye witness, namely, Ajay Prasad @ Ranjit Prasad was also recorded. This witness has stated that at the time of occurrence it was dark and two persons had come by the motorcycle and the motorcycle came close to them and one of those two persons opened fire to Ajay Pandit and after sometime another fire was also opened. On account of darkness he could not identify the assailants.

During investigation, after recording the confessional statement of Vinod Pandit and also the confessional statement of Praveen Pandit, the statements of two witnesses Pradeep Pandit and Dharmendra Pandit were also recorded. Both these witnesses have also stated that they had seen two motorcycles. One motorcycle was driven by Santosh Pandit and Vinod Pandit was the pillion rider of the same and other motorcycle was driven by Pankaj Pandit and Praveen Pandit was the pillion rider and they had also seen opening fire.

As per Injury Report, there is only one bullet injury on left side of the buttock.

In view of the submissions made, the bail application of the petitioner/applicant is hereby allowed. Let the petitioner/applicant be released on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty-five Thousand Only) with two sureties of the like amount to the satisfaction of the Court concerned in the aforesaid case.
