This bail application has been filed on behalf of the applicant– Debu Kalindi with prayer to release on bail in connection with Adityapur P.S. Case No. 50 of 2024 corresponding to N.D.P.S. Case No.11 of 2024 registered under sections 17/21(b)/25 of Narcotic Drugs and Psychotropic Substances Act, pending in the court of learned Principal District and Sessions Judge at Seraikella.

The learned counsel for the petitioner has submitted that the petitioner was apprehended by the police and from his possession 0.64 grams brown sugar is alleged to have been recovered in seven pouch from the pocket of his pant. The same is of small quantity. The petitioner is having no criminal antecedent and has been languishing in jail since 14.02.2024.

From the perusal of the FIR itself, there is no strict compliance of section 50 of NDPS Act. The quantity of the recovered contraband is small.

In view of the above, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
