Heard the learned counsel for the petitioner and learned A.P.P. for the State.

This bail application has been filed on behalf of the abovenamed petitioner with the prayer to release on bail in connection with Adityapur P.S. Case. No. 125/2023 (S), registered under Sections 272/273/34 of the Indian Penal Code read with Section 47a of the Excise Act, pending in the Court of Learned Chief Judicial Magistrate, Seraikella.

The informant police officer had received the information from the Superintendent of Police of the District concerned that a white colour Mahindra mini van was to come for transporting the illicit liquor and the entry of the same was made in station diary and raid was carried out along with police force by the informant and the said white colour Mahindra mini van was intercepted. The two persons began to flee away and one was apprehended at the spot but another managed to flee away taking advantage of the darkness. One apprehended person was identified as Gopal Jonko who further disclosed the name of the other person who fled away as Rajesh Hembram and on search being made of the vehicle, the illicit liquor was recovered and details of which is given in the FIR. Hence, the FIR was lodged.

disclosure made by the apprehended co-accused Gopal Jonko. The alleged recovery of illicit liquor which was made from the very vehicle, there is no independent witness of the seizure memo and admittedly there is no FSL report in regard to the liquor being noxious .

In view of the above, the bail application of the petitioner is hereby allowed. Let the petitioner be released on bail on furnishing the bail bond of Rs. 20,000/- (Rs. Twenty Thousand Only) with two sureties of the like amount to the satisfaction of the Court concerned in the aforesaid case.
