Heard learned counsel for the petitioner and learned APP for the State.

This bail application has been filed on behalf of the petitioner, namely, Ramlal Oraon with a prayer to release on bail in connection with Lohardaga Mahila P.S. Case No. 25 of 2023, registered under sections 376 of the Indian Penal Code and 416 of POCSO Act, pending before the Court of learned Additional Sessions Judge-I-cum-Special Judge, POCSO, Lohardaga.

The FIR of this case was registered by the order of learned Special Judge on the application made by the complainant under Section 156(3) of Cr.P.C. The complainant has shown her date of birth as 29.06.2004 and has alleged that in the year 2016 the accused Ramlal Oraon had come to her house in the evening and he forcibly took her to his house where he gave her some sweets to eat, whereby she felt herself intoxicated and he committed rape upon her. Since 2016, he had been continuously committing rape upon her and for four times she also has become pregnant and each time pregnancy was terminated, and this complaint was lodged to the concerned Judge.

On the date of first occurrence in the year 2016, victim was 12 years old. But it is also alleged that since 2016 and till the date of filing this complaint the accused had been continuously establishing physical relation with her and on the date of complaint, victim was 19 years old. After having attained the age of 18 years, she still continued to establish physical relation with the petitioner.

As jointly submitted by the learned counsel for the petitioner and also

by the complainant/informant/victim, the compromises has arrived between the petitioner and the victim, both have decided to get married and the victim is still residing in the house of the petitioner.

In view of the submissions made, the bail application of the petitioner/applicant is hereby allowed. Let the petitioner/applicant be released on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty-five Thousand Only) with two sureties of the like amount to the satisfaction of the Court concerned in the aforesaid case.
