Heard learned counsel for the petitioner and learned APP for the State. 2. This bail application has been filed on behalf of the abovenamed petitioner with prayer to release on bail in connection with Sitaramdera P.S. Case No.38 of 2023 in S.T. Case No.564 of 2023 registered under sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Additional Sessions Judge-I, Jamshedpur.

As per the allegations made in the FIR, on 27.03.2023 at 11:00 O’clock, the informant was along with his friend Anil Mukhi in the Civil Court, Jamshedpur. While he was going to his house from the Court, at the distance of 10-15 paces from the gate No.3, the accused Kundi (petitioner), Aman and 4-5 unknown persons were present there and Harpeet Singh was also making exhortation to kill the informant. Kundi and Aman both opened fire upon the informant however they managed to flee away through gate No.3 and again the fire was opened, of which, pillet touched his body part and hence this FIR.

The present petitioner is named in the FIR. The role of opening fire has been attributed to Kundi and Aman. As per injury report, there are three injuries abrasion and multiple puncture wounds (pillets like) on the elbow, knee and shoulder. The nature of injuries is shown simple in nature. So far as the criminal antecedent is concerned, the same has been explained by the petitioner in his bail application.

In view of the above, the bail application of the petitioner is hereby allowed. Let the petitioner be released on bail on furnishing bail bond of Rs. 25,000/(Rupees Twenty-Five thousand) with two sureties of like amount to the satisfaction of the court concerned in the aforesaid case.
