13/05.09.2023: Upon hearing the learned counsel for the parties, this Court passed the following, (Per, Sanjaya Kumar Mishra, C.J.)

O R D E R

By filing this petition, the petitioner has prayed for direction upon the

respondents for the following relief(s):-

(i) For installation of firefighting equipment in the three medical colleges and District level Hospitals in Jharkhand as the same has not been installed till date, even after the suo motu cognizance of this Court in WP(PIL) No. 4762 of 2016. (ii) To verify the firefighting equipments of the Nursing Homes and Private Hospitals in the State of Jharkhand and their working conditions as the most of the Hospitals have installed the equipments but the same is not functional. (iii) To submits the details of the efforts taken by the State in installing firefighting equipments in the Hospitals, as the failure to tackle the sudden erupt of fire will cause enormous loss of life.

A counter affidavit has been filed by the Commandant, Headquarters, Ranchi, stating therein that installation of firefighting equipments in any premises, either government or private, is the subject matter of the concerned owner of the premises. The answering respondent has only to verify and certify the quality and sustainability of the said firefighting equipment in the concerned buildings. Also the answering respondent would provide adequate training to operate the firefighting equipments in emergent situation. It is also submitted that before issuing any “No Objection Certificate” to any institution or

premises, the answering respondent verifies all firefighting equipments and after inspecting the premises regarding installation of firefighting equipment, provides no objection certificate. It is also brought to our notice that mock-drills are being conducted time to time in various schools, colleges, hospitals and government buildings to show how to save life and property of the person in case of fire. All the medical colleges have been fitted with firefighting equipments. The respondent is also in the process of completing installation of firefighting equipments in all government buildings etc.

In that view of the matter, the writ petition is allowed, directing the respondents to complete the installation of firefighting equipments in all government buildings including hospitals, schools, police stations, etc. within six months, hence.

There shall be no orders as to costs.

Let a free copy of this order be provided to the learned counsel for the State for early compliance of the order.
