“To issue Writ in the nature of mandamus commanding upon the Respondent State Authorities to produce the entire file of the Tender Committee in respect to BID No.JEPC/Civ./03/605/2020 (Part- 1)/1034 dated 20.03.2023 issued by the State Project Director, Jharkhand Education Project Council, Ranchi that shall disclose the actual fact that the Technical Bid of "The CINNAMON FLAVOURS OF NATURE" [Respondent No.3] has been accepted by the Tender Committee on basis of a forged document submitted by it and further it did not satisfy the other basic eligibility criteria as per the Bid Document dated 23-03-2023 and as per its Corrigendum, which is unfair, arbitrary, illegal, discriminatory and accordingly Writ of Mandamus be issued directing the Respondent State Authority to black list the Respondent-3 as per Clause 2.1 (xxi) of the BID Document and further this Hon'ble Court may be pleased to hold that the decision making process of the Tender Committee in rejecting the Technical BID of the Writ Petitioner is unfair, wrong, arbitrary, illegal, discriminatory, in violation to the principle of natural justice, since the Writ Petitioner satisfied all the eligibility criteria of Bidders, i.e., basic qualification as on 01-08-2022 as per BID Document and as such the Technical Bid Proceeding of the Tender Committee dated 04-07-2023 [Annexure-4] and the Tender Summary Report dated 20-08-2023 of the Tender Inviting Authority [Annexure-5] be quashed, whereunder the Writ Petitioner's Technical Bid has been rejected on flimsy & misconceived ground and further in fact & circumstances the present BID No.JEPC/Civ./03/605/2020 (Part-1)/1034 dated 20.03.2023 [Annexure-1] is fit to be cancelled and new Tender/e-BID for supply of Sports Items to 80SOE & 325 Adarsh Vidyalaya & Band Equipments to 56 SoE Schools through Rate Contract in Jharkhand may be invited afresh.”
