The petitioner, who is an accused for the offence punishable under Section 307/34 IPC & Sections 25(1-B)a/27/35 of the Arms Act, is praying for grant of regular bail.

Heard the learned counsel for the Parties.

The prosecution case as per the FIR is that two person riding a motorcycle, shot the informant and injured him.

From the impugned order it is apparent that the motorcycle bearing Registration No. JH07G 9403 was recovered and it is alleged that same was used by miscreants in committing the offence. The said motorcycle admittedly belongs to the petitioner. There is nothing in the impugned order to suggest that the petitioner was the person who was involved in the offence. Only on the basis that motorcycle which was used in the occurrence belongs to the petitioner, the petitioner has been implicated in this case.

Considering the aforesaid facts, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Principal District & Sessions Judge, Lohardaga in connection with Lohardagara P.S. Case No. 249 of 2021, corresponding to G.R. No. 01 of 2023 (S.T. No. 11 of 2023).
