5/16.06.2023: The petitioner is accused for the offence punishable under Sections(s) 384, 387 and 34 of the Indian Penal Code and Section(s) 17(1)(ii) of the CLA Act.

Counsel for the petitioner submits that the petitioner is not named in the FIR and the name of this petitioner has come only on the basis of confessional statement of co-accused.

It is alleged that two members of a company were caught with Rs.1,70,000/-, who happens to be the staff of a company, who had only handed over the money to the banned extremists organization. They have named this petitioner in their confessional statements.

Learned A.P.P opposes the prayer for bail of the petitioner but has not controverted the aforesaid submission.

Considering the fact that the petitioner is not named in the FIR and only on the basis of confessional statement of co-accused, his name has transpired in this case, I am inclined to release the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Chatra, in connection with Tandwa P.S. Case No. 94 of 2018, in connection with G.R. No. 856 of 2018, subject to condition that one of the bailers should be his close relative and he will appear before the trial court once in a month till the conclusion of the trial.
