5/16.06.2023: The petitioner, who is an accused for the offence punishable under Sections 394 IPC, is praying for grant of regular bail, as he is in custody since 23.09.2022.
Heard the learned counsel for the parties.
Some unknown miscreants robbed Rs.14,700/- by opening the cash counter of the shop and further 48 bottle of beer were also taken away.
It has been submitted that petitioner was not put on TIP and chargesheet has been submitted in this case.
Learned APP opposes the prayer for bail and submits that there are seven criminal antecedent against the petitioner.
Considering the fact that petitioner is in custody since 23.09.2022 and charge-sheet has been submitted and no likelihood of completion of trial in near future, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamshedpur in connection with Potka P.S. Case No. 53 of 2022, Corresponding to G.R. No. 1636 of 2022, subject to the condition that one of the bailors must be close relative of the petitioner, having sufficient landed property in his own name within the State of Jharkhand; the petitioner should appear once every month before the Trial Court; and further the bailors should give an undertaking that they will ensure appearance of the petitioner before the trial court, failing which it will be treated that bailors have violated the order of this Court and they shall be accordingly, proceeded against.
