The petitioner has been made an accused in connection with Deoghar (Cyber) P.S. Case No. 103 of 2021, for the offence under Sections 419, 420, 467, 468, 471 and 120-B/34 of the Indian Penal Code and Sections 66 (B), 66 (C ), 66 (D) and 84 (C ) of the Information & Technology Act, pending in the court of learned Additional Sessions Judge-II-cum-Special Judge, Deoghar.

On 20.11.2021, Cyber Police, Deoghar apprehended this petitioner on suspicion that he was cyber criminal.

One mobile phone, Keypad and ATM Card were recovered from his possession.

From perusal of the case diary, it appears that e-wallets were created using the SIM Card so recovered from the mobile phone of the petitioner.

However, there is nothing on record to show that the petitioner had cheated anyone.

Regard being had to the facts of the case, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Deoghar, in connection with Deoghar (Cyber) P.S. Case No. 103 of 2021.
