The anticipatory bail application filed on behalf of petitioner, who is apprehending his arrest in connection with Barhi P.S. Case No. 226 of 2021 for the offence registered under Sections 414, 34 of the Indian Penal Code and Section 21(III)/22/29 of the N.D.P.C. Act pending in the Court of learned Sessions Judge, Hazaribag, is pressed into motion.

It is submitted by the learned counsel on behalf of the petitioner that he has been falsely roped in this case only on account of that he is owner of the motorcycle from which 4 kg. 300 gm. Ganja was seized along with his Bhagina, who was carrying it under the instruction of one Lalu Yadav.

Learned A.P.P. has opposed the prayer for bail. It is submitted that the petitioner has no valid document regarding ownership of the motorcycle.

Considering the submissions made, the anticipatory bail application is allowed. Accordingly, the petitioner, above named, is directed to surrender before the learned Trial Court within a period of two weeks and in the event of his arrest or surrender, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of the Court below, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

The petitioner will co-operate in the investigation and will appear under Section 41A Cr.P.C. as and when required and comply with the condition as laid down under Section 438(2) of the Cr.P.C.
