Apprehending his arrest, petitioner- Devdas Giri has moved this Court for grant of privilege of anticipatory bail in connection with Baharagora P.S. Case No. 69 of 2021 registered under Sections 342, 498A of the Indian Penal Code and Sections 3/ 4 of D.P. Act.
Heard the parties.
As per the prosecution case the petitioner was married to the informant on 23.04.2021 and the case was lodged on 4.10.2021. After marriage, the informant was subjected to cruelty in reference to unlawful demand made by the petitioner.
It is submitted by learned counsel for the petitioner that the FIR does not state anything about assault and any unlawful demand and the present case has been filed on the vague allegation of harassment.
The Addl. P.P. assisted by learned counsel for opposite party no. 2 opposed the prayer for bail.
Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under section 438 (2) Cr. P.C.
The petitioner will cooperate in the investigation and will appear on notice under Section 41A of Cr. P.C.
