Heard Mr. Amit Kumar Choubey , the learned counsel for the petitioner and Mr. Ashok Singh, the learned APP for the State.
Mr. Amit Kumar Choubey, the learned counsel for the petitioner submits that the allegations are that the informant who is the brother of the contractor who is doing some work of some road had received a call from one Abhay Jee and he was asked to pay personal commission and thereafter during course of investigation, the petitioner was arrested, apart from this there is no other allegation against the petitioner. It is further submitted that the petitioner is in custody from 06.12.2021.
Learned counsel for the State, on the other hand, has opposed the bail application and pointed out that the petitioner belongs to extremist organization having as many as nine criminal cases against him and many of the witnesses, during investigation, supported the prosecution case, therefore the petitioner does not deserve bail.
Having heard both counsels, gone through the records of the case and in the facts and circumstances of the case, I am not inclined to release the petitioner, named above, on bail, at this stage.
Accordingly, the bail application of the petitioner is rejected, at this stage.
