Heard the parties.
The petitioner has been made an accused in connection with Bindapathar P.S. Case No. 18 of 2021, S.T. Case No.133 of 2021, for the offence under Sections 364, 302 & 201/34 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-III, Jamtara.
Son of the informant namely Arjun Mahato was having affairs with one Poonam Kole @ Poonam Kol, wife of Subhash Kol. In the night of 27.04.2021, Poonam Kole @ Poonam Kol called him to attend the marriage. Thereafter, he went missing.
From the impugned order, it appears that Subhash Kol was apprehended and his confession led to the recovery of dead body of Arjun Mahato. He has also named the petitioner as an accomplice.
It was submitted that apart from confession of co-accused, there is no other material against the petitioner on record. It was further submitted that Poonam Kole @ Poonam Kol has been granted bail by this Court in B.A. No.970 of 2022.
Regard being had to the facts of the case, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-III, Jamtara, in connection with Bindapathar P.S. Case No. 18 of 2021, S.T. Case No.133 of 2021.
