Petitioner has been made an accused in connection with Ichak P.S. Case No.133 of 2021 arising out of N.D.P.S. Case No.42 of 2021, registered under Section 22B of N.D.P.S. Act and Sections 18(c)/27(b)(ii) of Drugs and Cosmetic Act, pending in the Court of learned A.D.J.-II, Hazaribagh.
Bail application of this petitioner was earlier rejected by this Court in B.A. No.9521 of 2021 vide order dated 27.11.2021.
Fresh application is filed on the ground that petitioner is in custody for more than a year.
It appears that petitioner was apprehended alongwith coaccused persons and on search 15 bottles of Maleate & Codeine Phosphate Syrup and 18 Nitrazepam Tablets were recovered from their possession.
Considering the fact that petitioner has already remained in jail for more than a year, he is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Hazaribagh, in connection with Ichak P.S. Case No.133 of 2021 arising out of N.D.P.S. Case No.42 of 2021.
