The petitioner has been made an accused in connection with T. Tangar P.S. Case No.30 of 2018, corresponding to N.D.P.S. Case No.03 of 2018 (S), for the offence under Sections 414/34 of the Indian Penal Code and Sections 20 & 22 of NDPS Act, pending in the court of learned District Judge-cum-Special Judge, NDPS, Simdega.

Bail application of this petitioner was earlier rejected in B.A. No.13767 of 2021 vide order dated 03.02.2022.

It is alleged that on 26.07.2018 at about 11:30 A.M, the informant party laid an ambush near T. Tangar Police Station in Ambapani Ghati and intercepted one Bolero. The occupants of the vehicle managed to escape. On search, 109 Kg. Cannabis were recovered from the said vehicle. The petitioner is said to be the owner of the seized vehicle.

It was submitted that this bail application was filed on the fresh ground that the petitioner was suffering from liver cirrhosis and needs medical treatment on regular basis.

Report was called for from the Medical Superintendent, RIMS, Ranchi which has been received, wherein, it has been stated that the petitioner is actually suffering with chronic liver cirrhosis and portal hyper tension.

It appears that the petitioner requires special medical treatment on regular basis.

It was submitted that the petitioner is in custody for about a year.

Regard being had to the facts of the case and also considering the fact that the petitioner is suffering from liver ailment, I am inclined to release the petitioner, on bail.

Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.50,000/-(Rupees Fifty Thousand) with two sureties of the like amount each, to the satisfaction of learned District Judge-cum-Special Judge, NDPS, Simdega, in connection with T. Tangar P.S. Case No.30 of 2018, corresponding to N.D.P.S. Case No.03 of 2018 (S).
