Pritam Kumar Vs the State of Jharkhand

Petitioner is apprehending his arrest in connection with Lokainayanpur P.S. Case No. 17/2020, registered under Sections 272/ 273/ 414/ 34 of the Indian Penal Code and Section 47(A) of the Excise Act, pending in the Court of Smt. Sonam Vishnoi, learned J.M.F.C., Giridih.

On 13.12.2020 at about 05:00 P.M., on the basis of confidential information informant party recovered foreign liquors from two vehicles. Petitioner happens to be the owner of vehicle bearing registration No. JH20A-5121 from which 50 pieces of Old Monk of 750 ml volume was recovered.

It was submitted that the driver of the vehicle without the knowledge of the petitioner was transporting the seized contraband.

Regard being had to the facts and circumstance of the case, I am inclined to extend the privilege of Anticipatory Bail to the petitioner. He is directed to surrender before the court below within two weeks from the date of receipt/production of copy of this order, and in the event of his arrest or surrender he shall be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction Smt. Sonam Vishnoi, learned J.M.F.C., Giridih or her successor in connection with Lokainayanpur P.S. Case No. 17/2020, Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
