Apprehending his arrest, petitioner- Rabindra Nath Tiwari has moved this Court for grant of privilege of anticipatory bail in connection with Complaint Case No. 2518 of 2019 registered under Sections 33, 52 of the Indian Forest Act.

Heard the parties.

It is submitted by learned counsel for the petitioner that the land in question is the Khatiyani raiyati land standing in the name of the grand-father of the petitioner and the revenue receipt is being issued in the name of father of the petitioner. The title suit has been filed by the forest department with respect to the suit land and the matter is sub-judice. It is further submitted that Plot Nos. 57 and 110 had been received by the ancestor of this petitioner in Partition Suit No. 57 of 1970 and after vesting these plots also figured in M Form.

The Addl. P.P. opposed the prayer for bail.

Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under section 438 (2) Cr. P.C.
