09/ 03.08.2022 . Apprehending his arrest, petitioner abovenamed has moved this Court for grant of privilege of anticipatory bail in connection with Mahila (Sadar) P. S. Case No.10 of 2021 registered under Sections 498A, 313, 494, 354, 307, 328, 34 of the Indian Penal Code and under Sections 3 /4 of D. P. Act.
Heard the parties.
It is submitted by learned counsel for the petitioner that the petitioner is the husband and marriage took place in the year 2019. It is further submitted that omnibus and general allegations have been levelled under many Sections of the Indian Penal Code, but the offence will not be made out. The main bone of the contention is that the petitioner has allegedly performed second marriage with one Khusboo Devi.
Learned APP for the State assisted by learned counsel for the Informant has vehemently opposed the prayer for grant of anticipatory bail. The informant has been deceived into marriage with the petitioner concealing the first marriage with Somi Kumari Rana. There are other direct allegation against the petitioner of subjecting the informant to cruelty.
Considering the submissions of learned counsels and the fact as discussed above, the anticipatory bail application of the petitioner is rejected. The petitioner is directed to surrender before the learned court below within two weeks from today.
