Apprehending his arrest, petitioner- Rabindra Nath Tiwari @ Rabindra Nath Tiwary has moved this Court for grant of privilege of anticipatory bail in connection with Complaint (Chainpur Forest) Case No. 2508 of 2019 registered under Section 33 of the Indian Forest Act.

Heard the parties.

It is submitted by learned counsel for the petitioner that the land in question is Khatiyani raiyati land standing in the name of the grand-father of the petitioner and the revenue receipt is being issued in the name of father of the petitioner. The title suit has been filed by the forest department with respect to the suit land and the matter is sub-judice. It is further submitted that Plot Nos. 57 and 110 had been received by the ancestor of this petitioner in Partition Suit No. 57 of 1970 and after vesting these plots also figured in M Form.

The Addl. P.P. opposed the prayer for bail.

Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under section 438 (2) Cr. P.C.

The petitioner will cooperate in the investigation and will appear on notice under Section 41A of Cr. P.C.
