05/ 02.08.2022 . Apprehending his arrest, petitioner above-named has moved this Court for grant of privilege of anticipatory bail in connection with Ghaghra P. S. Case No.128 of 2021 registered for the offence under Sections 302/201 of the Indian Penal Code.
Heard the parties.
It is submitted by learned counsel for the petitioner that as per the First Information Report lodged by Rina Devi is that three days ago when she enquired from one Birsi Devi, it was informed that about 8 days ago, her mother had gone with her maternal-uncle and thereafter had not returned. On further enquiry, it was found that on 08.12.2021, she had gone with one Saniya Oraon to the jungle and thereafter said Saniya Oraon had returned, but her mother did not return from there. It has also been stated that this petitioner had threatened her mother with life when she objected to his irrigating the field regarding which Panchayati was also convened. The petitioner has earlier threatened the deceased with life. It is submitted by the learned counsel appearing on behalf of the petitioner that there is no direct eye-witness nor any circumstantial evidence to implicate the petitioner in the instant case .
Learned APP for the State has opposed the prayer. It has been submitted that as per the post-mortem report it was a homicidal death. It has further been submitted that the petitioner had earlier threatened the deceased with life and the matter is still under investigation.
Considering the submissions of learned counsels and considering the gravity and direct allegation against the petitioner, the anticipatory bail application of the petitioner is rejected. The petitioner is directed to surrender within two weeks.
