Apprehending his arrest, petitioner above-named has moved this Court for grant of privilege of anticipatory bail in connection with Adityapur P.S. Case No. 150 of 2021 for the offence registered under Sections 341, 323, 498A, 406, 420, 120B, 387, 376 of the Indian Penal Code.

As per the case of the prosecution, the marriage took place in the year 2019. In course of marital life, the Opp. Party No.2 accorded financial help to the petitioner to the tune of Rs.3 Lacs out of her income from job. The accused persons further demanded Rs.2 Lacs in lieu of her acceptance as legally wedded wife of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is a Constable in the State of West Bengal and has committed no offence and the offence as alleged is not made out. The informant had earlier lodged First Information Report vide Jhargram P. S. Case No.38 of 2020 in which the petitioner has already been enlarged on bail.

The Addl. P.P. opposed the prayer for bail.

Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under section 438 (2) Cr. P.C.

The petitioner will cooperate in the investigation and will appear on notice under Section 41A of Cr. P.C. and comply with the condition(s) as laid down under Section 438(2) of the Cr. P.C.
