Apprehending his arrest, petitioner above-named has moved this Court for grant of privilege of anticipatory bail in connection with Govindpur P.S. Case No. 258 of 2021 for the offence registered under Sections 498A /341/ 323/ 504/34 of the Indian Penal Code and Sections 3 /4 of Domestic Violence Act.

Heard the parties.

It is submitted by learned counsel for the petitioner that marriage between both the parties took place about 5 years ago before institution of the present case. It has further been submitted that there is no allegation of any assault in the entire First Information Report and further there is no reference to any unlawful demand. However, the only allegation is that after the year 2019, there had not been any contract between both the sides and the petitioner was not ready to divorce the informant.

The Addl. P.P. opposed the prayer for bail. It is submitted that the father-in-law of the informant has kept an illegal gun and he has procured the licence for the same from Nagaland. It is further submitted that the petitioner was asked to stop teasing the informant.

Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under section 438 (2) Cr. P.C.

The petitioner will cooperate in the investigation and will appear on notice under Section 41A of Cr. P.C. and comply with the condition(s) as laid down under Section 438(2) of the Cr. P.C.
