The present writ petition has been filed for issuance of direction upon the respondents to pay due compensation along with interest to the petitioner for acquisition of his raiyati land appertaining to Plot Nos. 894 & 638, corresponding to Jamabandi No. 22, situated at Mouza-Hathi Bathan, measuring an area of 0.25 acre each.

The grievance of the petitioner is that the said land was acquired by the respondents in the year 2010 for widening of Govindpur-Sahebganj road. According to the petitioner, though he is the Raiyat of the said land, yet due to some frivolous objection made by certain persons, the compensation in lieu of said acquisition could not be disbursed to him. The petitioner has claimed that he has represented before the respondent Nos. 2 & 3 on the present issue, however, no action has been taken on the same which has compelled him to file the present writ petition.

Having heard learned counsel for the parties and keeping in view the nature of the prayer made by the petitioner in the present writ petition, without entering into the merit of the case, the petitioner is given liberty to prefer a fresh representation before the respondent No.3 on the present issue. On receipt of such representation, the respondent No.3, after providing due opportunity of hearing to all the concerned parties, shall take an appropriate informed decision in accordance with law within a period of three months from the date of filing of the said representation.

The present writ petition is accordingly disposed of with the aforesaid liberty
