The learned counsel for the petitioner submits that the petitioner was earlier granted bail by this Court in connection with the present case vide order dated 24th March, 2017 passed in B.A. No.2406 of 2017. It is further submitted that subsequently the petitioner was sent to judicial custody in connection with Bistupur P.S. Case No.367 of 2017. In the meantime, the present case was committed to the court of Sessions and thereafter on 4th December, 2017, the same was put for appearance of the accused persons by the learned Sessions Judge, Serraikella. Since the petitioner was not present on the said date before the court due to his being in judicial custody in aforesaid case, his bail bond was cancelled. Order dated 4th September, 2018 passed by the learned trial court will suggests that the said fact was subsequently brought to the notice of the said court and, hence, a production warrant was issued for his remand in the present case. He was thereafter produced before the trial court on 1st October, 2018. It would, thus, be evident from the aforesaid fact that there is no misuse of privilege of regular bail earlier granted to the petitioner. Hence, he may be given the privilege of regular bail.
