Heard learned counsel for the parties.

Petitioner is an accused for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected by this Court vide order dated 14.03.2019 passed in B.A. No. 1398 of 2019. By way of present bail application, the petitioner has renewed his prayer for regular bail primarily on the ground that he is in judicial custody since 25.09.2018 and out of seven prosecution witnesses, five witnesses who have been examined so far, have not stated anything material against the petitioner. The petitioner could not appear before the concerned trial court in time to face the trial as he was not aware of his implication in the present case and had gone outside of the State to earn his livelihood. The petitioner undertakes that he will fully co-operate in timely conclusion of the trial. At least considering the length of judicial custody, the petitioner may be given the privilege of regular bail.

Learned A.P.P. opposes the petitioner’s prayer for bail.

Having heard the learned counsel for the parties, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.25,000/(rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Chaibasa in connection with Sessions Trial No. 38 of 2019, subject to the condition that the petitioner shall co-operate in the trial and shall appear before the trial court on each and every date fixed in the trial till conclusion of the same unless his physical presence is exempted by specific order of the trial court for a particular date, failing which the said court is at liberty to cancel the bail bond of the petitioner.
