The present writ petition is taken up today through Video conferencing.

The present writ petition has been filed for issuance of direction upon the state-respondents for demolition of residential house illegally constructed over Khata no. 47, Mauza No.- 467, Khesra No. 473 MouzaNarottampur, District- Godda measuring an area of 10 katha 05 dhur (hereinafter referred to as “the said land”) under the ‘Prime Minister Housing Scheme’.

3. According to the petitioner, the respondent no. 9 has illegally made construction of house in collusion with the respondent no. 8 over the said land under the ‘Prime Minister Housing Scheme’.

Having heard the learned counsel for the parties and keeping in view the nature of the prayer made by the petitioner in the present writ petition, without entering into the merit of the case, the petitioner is at liberty to file fresh representation on the present issue before the respondent no. 2- The Deputy Commissioner, Godda. On receipt of the said representation, the respondent no. 2, after providing due opportunity of hearing to all the concerned parties and on making inquiry, if so required, shall take an appropriate informed decision within a period of six months from the date filing of the said representation.

5. The writ petition is disposed of with aforesaid liberty and direction.
