The matter was taken up through Video Conferencing. Learned counsel for the parties had no objections with it and submitted that the audio and video qualities are good.

03/07.07.2021: The present appeal has been filed under Section 14(A) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act.

2. Heard Mrs. Ritu Kumar, learned counsel appearing for the appellant and Mrs. Nehala Sharmin, learned A.P.P. appearing for the State and Mr. Rajendra Pd. Gupta, learned counsel appearing for the informant.

3. The criminal appeal has been filed against the impugned order dated 04.01.2020 passed by the learned Special Judge, SC/ST Act, Hazaribag in SC/ST Case No.55 of 2019 in connection with Ichak P.S. Case No.88 of 2019, for the offence under Sections 363, 120-B, 302 and 34 of the Indian Penal Code in which 364 of the IPC was added later on, now pending in the court of the learned Additional Sessions Judge-I-cum-Special Judge SC/ST Act, Hazaribag.

4. It has been submitted by the learned counsel for the appellant that the appellant is in custody since 03.06.2019. It has been further submitted that the FIR has been lodged under Sections 363, 120B and 34 of the Indian Penal Code but subsequently, prayer has been made for addition of sections 302, 120B and 201 of the Indian Penal Code.

A report has been called for vide order dated 14.06.2021 passed in analogous cases by this Court. As per the report, the trial is in advance stage and out of eight charge-sheeted witnesses, three witnesses have already been examined and the rest witnesses have been summoned.

5. In view of nature of allegation and the materials available on record, I am not inclined to enlarge the appellant on bail. Accordingly, the prayer for bail of the appellant is rejected and the instant appeal being Criminal Appeal (S.J.) No.127 of 2020 is, hereby, dismissed.

6. However, if the trial is not concluded within nine months, the appellant is at liberty to renew his prayer for bail.
