Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner has been made accused in connection with Adityapur P.S. Case No.99 of 2020, Sessions Trial No.22 of 2021 for the offence under Sections 147, 148, 149, 341, 323, 506, 379, 307 of the Indian Penal Code and Section 27 of the Arms Act, pending in the Court of learned Principal District & Sessions Judge, Seraikella.
The prosecution case was instituted on the basis of fardbeyan of the informant, Ajmeri Bibi, alleging therein that on 06.08.2020 at about 8:30 A.M, the accused persons, including the petitioner came to her and threatened her to withdraw the rape case, which was earlier instituted by her, when she refused, the accused persons assaulted the informant and also abused her.
Similarly situated co-accused persons have been granted bail by a coordinate bench of this Court.
Considering the facts of the case, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Principal District & Sessions Judge, Seraikella, in connection with Adityapur P.S. Case No.99 of 2020, Sessions Trial No.22 of 2021.
