Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has been made accused in connection with Kolebira P.S. Case No.29 of 2009, corresponding to G.R Case No.218 of 2009 (S-III), S.T NO.06 of 2019 for the offence under Sections 147, 148, 149, 353, 307, 121A of the Indian Penal Code, Section 25 (1-B) (a), 26, 27, 35 of the Arms Act, Section 13 of the UAP Act, Section 17 of the CLA Act and Sections 3 / 4 of the Explosive Substance Act, pending in the Court of learned Additional Sessions Judge-I, Simdega.

The FIR was instituted on the basis of written report of the informant, Niraj Kumar Singh, Officer In-charge of Kolebira Police Station, alleging therein that on 22.7.2009 at about 5:30 P.M, he received confidential information that some extremists belonging to C.P.I Maoist group had assembled in the Kherganja forest at Kolebira. On receiving the said information, the informant party went to the place of occurrence. There was an encounter between the extremists and the informant police party.

So far as the petitioner is concerned, he was not arrested at the spot. It appears that one co-accused, Matius Minz was apprehended and the name of the petitioner has come in his confession.

Similarly situated co-accused persons have been granted bail earlier by a coordinate bench of this Court.

Considering the facts of the case, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Simdega, in connection with Kolebira P.S. Case No.29 of 2009, corresponding to G.R Case No.218 of 2009 (S-III), S.T No.06 of 2019.
