Although notice has been served to O.P. No. 2 but none appears on behalf
of her.
The petitioner is an accused in connection with Garhwa (Mahila)P.S. Case No. 36 of 2020, G.R. No. 963 of 2021.
The marriage of the informant was solemnized with the petitioner in the year 2011. It has been alleged that after marriage, there was a demand of Rs.2,00,000/- and one Apache motorcycle and on non fulfillment of which, she was subjected to torture and ultimately she was ousted from her matrimonial house. It has further been alleged that the petitioner has also solemnized a second marriage.
The petitioner is in custody since 5.3.2021, which indicates that he has remained in custody for seven months before he has been granted provisional bail on 5.10.2021.
On consideration of the above, provisional bail granted to the petitioner by order dated 5.10.2021 is hereby confirmed.
This application stands allowed.
