The present application has been filed for grant of regular bail to the petitioner in connection with Jaldega (Bansjor O.P.) P.S. Case No.59 of 2019, registered for the offence under Sections 414/34 of the Indian Penal Code and under Sections 20, 22 and 27(a) of the N.D.P.S. Act.

Learned counsel for the petitioner has submitted that two persons had been arrested with 68 k.g. of ‘Ganja’ and they were sent to custody on 04.11.2019 since then the petitioner is in custody. It has further been submitted that the similarly situated co-accused person namely Erosh Sabar has already been granted bail by the co-ordinate bench of this Court vide order dated 24.09.2020 passed in B.A. No.5668 of 2020. On the above fact, the prayer for bail has been made.

On the other hand, counsel for the State has opposed the prayer for

Considering the material available on record and the fact that the coaccused has already been granted bail, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Principal & Sessions Judge-cum-Special Judge at Simdega in connection with Jaldega (Bansjor O.P.) P.S. Case No.59 of 2019, subject to condition that the petitioner will submit self-attested photocopy of his Aadhar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
