The present application has been filed for grant of regular bail to the petitioner in connection with Latehar P.S. Case No.172 of 2020, corresponding to G.R. Case No.590 of 2020, registered under Sections 498(A), 302 and 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Learned counsel for the petitioner has submitted that the petitioner is in judicial custody since 06.07.2020. It has been further submitted that the F.I.R. has been lodged against this applicant under Section 302 of the IPC and charge sheet has been filed under Sections 341, 323, 498(A) and 304(B) of the IPC. Post mortem report suggests that death is due to low blood pressure which might be due to complication in pregnancy.
Learned A.P.P. has opposed the prayer.
Considering the material available on record and the post mortem report, the petitioner, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Latehar P.S. Case No.172 of 2020, corresponding to G.R. Case No.590 of 2020 subject to the conditions that the petitioner will submit self attested copy of his Aadhar Card and also give his mobile number before the learned court below which he will not change during pendency of this case without prior permission of the court.
