The matter was taken up through Video Conferencing. Learned counsel for the parties had no objections with it and submitted that the audio and video qualities are good.

03/05.01.2021 : The present application has been filed for grant of regular bail to the petitioners in connection with Arki Police Station Case No.22 of 2020, corresponding to N.D.P.S. Case No.13 of 2020, registered for the offence under Sections 8/18 of the N.D.P.S. Act.

Learned counsel for the petitioners has submitted that both the petitioners are farmer and cultivating plants of opium. From the possession of the petitioners one pump set and some electric wire had been seized. Further four pieces of plants have been seized but till date it has not been ascertained that whether it is an opium plant or not. The petitioners are in custody since 16.03.2020.

Counsel for the State has opposed the prayer for bail.

Considering the period of custody and the pending investigation, the petitioners, named above, are directed to be released on bail, on their furnishing bail bonds of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned (I/C) Special Judge (NDPS), Khunti, in connection with Arki Police Station Case No.22 of 2020, corresponding to N.D.P.S. Case No.13 of 2020, subject to condition that the petitioners will submit self-attested photocopies of their Aadhar Card and also submit their mobile numbers before the learned court below which they will always keep active and not change it during pendency of this case without prior permission of the court.
