The matter was taken up through Video Conferencing. Learned counsel for the parties had no objections with it and submitted that the audio and video qualities are good.
05/04.01.2021 : The present application has been filed for grant of regular bail to the petitioners in connection with Gopikandar P.S. Case No.26 of 2019, registered under Sections 302, 201 and 34 of the IPC.
Learned counsel for the petitioners has submitted that the applicants have no criminal antecedents and in fact they have been implicated in the present criminal case on the basis of suspicion and so called statement of the deceased Anjali Kumari. They have referred the statement of Ms. Anjali Kumari made under Section 164 of the Cr.P.C. It has been submitted that they are in custody since 09.10.2019 and charge has been framed in February, 2020.
Counsel for the State has opposed the prayer for bail.
Considering the period of custody and the material available on record, the petitioners, named above, are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-III, Dumka in connection with Gopikandar P.S. Case No.26 of 2019, subject to condition that petitioners will submit their mobile numbers before the learned court below which they will keep always active and should not change during the pendency of this case without prior permission of the court.
