The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities are good.

04/19.01.2021 The present application has been filed for grant of regular bail to the petitioner in connection with Chirkunda P.S. Case No.40 of 2020, registered under Sections 420/ 467/ 468/ 471/ 120(B) and 406/34 of the Indian Penal Code.

Learned senior counsel for the petitioner has submitted that the applicant in is in judicial custody since 21.05.2020. It has been further submitted that there was a sale and purchase of land between the applicant and the complainant through Shankar Bhandari. There was some dispute for which Shankar Bhandari has filed a complaint case against informant on 03.05.2017. As a counter blast, present case has been filed in the year 2020 against this applicant also. It is an admitted position that there was an agreement between the parties.

Learned A.P.P. has opposed the prayer for bail of the petitioner.

Considering the material available on record and the fact that it is a civil transaction between the parties and there is a dispute of money and land, the petitioner, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Dhanbad in connection with Chirkunda P.S. Case No.40 of 2020 subject to the condition that petitioner will submit self attested copy of his Aadhar Card and also give his mobile number before the learned court below which he will not change during pendency of this case without prior permission of the court.
